India Regulatory Compliance

The Indian statutory and sectoral regimes DECTIFY operates under, beyond data protection and cyber — company law, evidence, drones, roads, and public procurement.

1. Corporate and financial

2. Evidence, criminal procedure and lawful demands

The Bharatiya Nagarik Suraksha Sanhita, 2023 replaced the Code of Criminal Procedure. Section 94 empowers a court or an officer in charge of a police station to require production of a document or thing. The Bharatiya Sakshya Adhiniyam, 2023 governs the admissibility of electronic records and the certificate that must accompany them. Section 91 of the Information Technology Act, 2000 and section 69 of that Act govern interception, monitoring and decryption directions.

How DECTIFY responds to a demand under any of these — what we require before we act, what we refuse, what we narrow, and when we tell the customer — is set out in full at Government and Law Enforcement Requests. In short: we require valid legal process, we produce the minimum the process actually compels, and we notify the affected customer unless we are prohibited from doing so.

3. Product-specific regimes

3.1 Aerial operations — SkyResponder / AERION

  • Drone Rules, 2021 and subsequent amendments, administered by the Directorate General of Civil Aviation.
  • Unique Identification Number for every aircraft; type certification for the platform; Remote Pilot Certificate for every operator.
  • Airspace zones — green, yellow and red — per the Digital Sky platform; prior permission for yellow zone operation and prohibition in red zones.
  • Beyond visual line of sight operation only under an approved exemption or within a sanctioned corridor.
  • No-permission-no-takeoff enforced in software; geofencing against the published airspace map.
  • Third-party insurance as the Rules require.

Operating conditions specific to the product are in the Product-Specific Terms. Customer remains the operator for regulatory purposes unless the Order Form records DECTIFY as operator.

3.2 Roads and vehicles — DriveLink and Traffic Detection

  • Motor Vehicles Act, 1988 and the Central Motor Vehicles Rules, 1989, including the standards for high security registration plates that affect read accuracy.
  • Motor Vehicles (Amendment) Act, 2019, section 136A, on electronic monitoring and enforcement of road safety, and the rules made under it governing the placement and calibration of enforcement devices.
  • Where a customer uses outputs for enforcement, the customer holds the statutory authority; DECTIFY supplies the technology and the evidentiary record, not the power.
  • DECTIFY holds no access to the VAHAN database or any registration record, and does not resolve a plate to a keeper.

3.3 Telecom and connectivity

Where a deployment uses cellular connectivity, the applicable licence conditions and the Telecommunications Act, 2023 apply to the connectivity provider. DECTIFY does not hold a telecom licence and does not provide telecommunication services.

4. Employment and workplace

DECTIFY complies with the applicable central and state labour legislation, including the Code on Wages, 2019, the Industrial Relations Code, 2020, the Occupational Safety Health and Working Conditions Code, 2020, the Code on Social Security, 2020, the Payment of Gratuity Act, 1972, and the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, under which an Internal Committee is constituted.

Where a customer deploys DECTIFY systems to observe its own workforce, that customer's obligations under employment law, including any duty to consult, are the customer's own. Our Acceptable Use Policy prohibits productivity monitoring and automated disciplinary action.

5. Public procurement and government customers

Accessibility conditions applying to government supply are at India Accessibility and Inclusion, clause 4.

Government contract terms prevail. Where DECTIFY contracts with a government buyer under GeM or a tender-issued contract, the buyer's conditions take precedence over the Terms and Conditions to the extent of any conflict — except that the Acceptable Use Policy and the human-review obligation are not negotiable and apply to every deployment without exception.

6. Environmental and product compliance

  • E-Waste (Management) Rules, 2022 — extended producer responsibility for hardware placed on the market, registration with the Central Pollution Control Board, and take-back arrangements.
  • Bureau of Indian Standards compulsory registration for applicable electronic products.
  • Wireless Planning and Coordination equipment type approval and spectrum compliance for any radio-equipped device.
  • Legal Metrology (Packaged Commodities) Rules, 2011 declarations on packaged hardware.

7. Keeping this current
